    Default waivers for prior service...

    i am prior service, been out since 93, my seperation code is jfl, re entry is RE3, i know i would have to get a waiver for that, im 37 yrs old, married, my kids live with my ex wife, i have joint custody, do i have to sign over full custody to her in order to get back in?? i know i would if i was going active, not sure on the guard though.

    You do not need to give up custody of your children. Since you said that you're married and that your children live with your ex-wife, I assume that you're divorced and remarried. The regualtion does not say anything about your current spouse having to be the mother of your children. According to the regulation, Prior service soldiers can have as many children as they want, as long as they are married. You will not need an additional waiver for your children.
