Prior Navy in need of direction

Im prior navy i was discharged last year on Aug 25th 2005 with an OTH and an RE-4 i admit i made some mistakes and i paid for them but i want to come to the guard to start a new page and better myself. I have everything ready to go my information packet,waiver letter,reference letters,associate degree,
my recruiter told me that he couldn't enlist me because i have an OTH i just want to get some input on what i should i do because i refuse to give up. I was told that that the Guard isn't enlisting anyone with an OTH,i was also told that i had to wait for the new fiscal year in october to start. Can someone clarify on how the guard works with people who have OTH's im located in Southern California.

OTH discharge is a disqualifier from enlisting in the Army National Guard. According to the current NGB 600-200 Enlistment Criteria:

"Applicants discharged with a character of service of 'Other Than Honorable', 'Bad Conduct', or 'Dishonorable'...are ineligible for enlistment - no waiver authorized."

OTH discharge is a disqualifier from enlisting in the Army National Guard. According to the current NGB 600-200 Enlistment Criteria:

The NGB 600-200 does not just apply to Vermont. An OTH discharge is a disqualifier. VER1172, if you are going to MEPS on Friday, I wish you the best of luck, but I'm just telling you what the regualtion says. (Ch 2-25 (c.))

Going to MEPS on Friday is a sure way to pick up a disqualification for Fraudulent Entry on top of your OTH if the fact that you have an OTH is not disclosed. Once your records are checked during assession it most likely will be picked up and you may run into a chance of permanently disqualifying yourself. NGB 600-200 applies nationwide, no state is exempt from the enlistment criteria required by this regulation.

The only way to join would be to request a change to the character of service on your current discharge and the findings of the review board granting a such change. You're not eligible to enlist with an OTH and no waiver is authorized for such action.

I was discharged in May of 03 with an OTH for U.A. I received an OTH with an RE-4. I was working with a Guard Recruiter in the San Diego area. I had all of my paper work done and even went to the MEP'S in L.A. I was also contacted by Sacramento for my family's SS numbers. Just before I was to get my id card, the recuiter called me and told me that my enlistment was kicked back. I did not hide anything from him and even had a state waiver. I would like nothing more then to get back in. I have letters of recommendations from my old cammand. My wife and I have also sent in my paper work to the Navy Review Board. It has been about a yr. since we did that. I am just wondering if there is anyone that can help. "i.e recruiter" If so, I would be very greatful!

Both of you will need to feild a BCNR appeal to request an 'upgrade' of your discharge.

Takes about 18 months.

Your best bet is to request only the upgrade of the discharge to General (Under Honorable) on grounds you have changed and include those recommendations.

It will likely be declined.

You can then appeal in district court and get a jury of your peers (civilians).

This is your best bet. If you want to speed it along, file in court now in assumption it will be declined. Otherwise, you are looking at 24 months plus.

Get an attorney.

I filed my BCNR in 2001 after 3 years of fact and records collecting.

It took 20 plus months and was rejected.

I was discharged from the Navy in November 2005. I am not seeking a commission in the N.G.

Hopefully a recruiter will call me back soon. Walking into offices haven't help because everyone simultaneously says "I only work with enlisted people."

Anyway, I have a general discharge, under honorable conditions. My discharge code is BKM and the stated reason is Misconduct. I had an extramarital affair and the young lady posted nude pics of me to the web ad set them to my command when I broke it off. It was admittedly stupid and I was definitely wrong. But boy was I surprised when they recommended me for discharge after first saying it was just a letter of reprimand offense.

My options were to fight the recommendation or resign and get a general discharge. My appointed lawyer had never fought a case with an officer and never won any of the 3 he had tried. He did know that if we lost, and the ability was great because he knew of no winning cases, the board would recommend a dishonorable discharge and it would likely be approved. I resigned.

Can I get in the guard here in Washington? Does it work towards my retirement? And what are the options and probabilities for getting my discharge upgraded.
