View Full Version : Being DENIED GI bill and kicker!!??!!

Ok, I re-enlisted for a 6 year contract back into a MOS (67N now 15M) that I previously held when I got out back in 97. I purposely signed up for the 6 year term so I could take advantage of the GI Bill and Kicker because I'm currently in a program with my work where I'll be getting my associates degree. But now I'm being told I can not get the GI Bill and Kicker because I've had more than a 365 day break in service? Anyone know anything of this? My recruiter didn't know anything of it but is trying to look into it further. It was also mentioned that I could change to a 3 year contract and then when I re-enlist at the end of 3 years for 6 years I'd then be eligible for the GI Bill? Not that it would do me any good then because I'd be done with my degree program. Any advice???

Who is telling you that a break in service makes you ineligible? I've not heard of such a thing, and I haven't found it in my previous research on MGIB eligibility (http://www.gibill.va.gov/pamphlets/CH1606/CH1606_Pamphlet_General.htm). Whoever denies your benefit needs to show you chapter and verse in the law or regulation why you are not eligible. Be professional, but firmly insist on seeing the relevant controlling document. I've seen sometimes that a clerk will give the right answer to the wrong question.

Ok here is a question. Were you in the RA?? If so did you pay $1200 for 1 year?? If so then you have the MGIB and it is good for 10 years. What the Major stated is correct. Now if you have the Active MGIB you will not get the Select Reserve MGIB. You can not have both.

Hey sorry I haven't gotten back to either of you sooner. Lost a hard drive in my desktop and forgot all about checking this forum until recently. I was told by SFC Rachel Flaksman (RI Joint Task Headquarters )that I was not eligible for the GI bill or kicker. I am prior service Mass Army National Guard (11 years) then had a 10 year break (ETS'd Honorable discharge). In Feb 06 I enlisted into the RI Army National Guard. As it stands supposedly phone calls were made and I won't be getting any GI Bill or kicker. :mad:

ALCON,

Check the form it will tell you nearly everything you need to know.

Remember the MGIB is NOT a National Guard or Army program..it is owned by the Veteran's Administration.

Check www.va.gov for more information. The NGR 600-7 (Selected Reserve Incentive program - aka SRIP) does not address the MGIB.

However AR 135-7 does address it in a general manner.
