View Full Version : Navy RE-4 = re-enlist ?

I got an RE-4 KFS Other Than Honorable discharge (Narrative says In Lieu of Trial by Court Martial) from the NAVY in July 2001. I got this discharge because i went AWOL from Basic Training for a few months and when i turned myself in to the base, i was given the above type of discharge in an administrative hearing. I read somewhere on the forum that it is possible for somebody with my discharge from the NAVY to get a waiver/upgrade through NGB and join the Army National Guard (i believe it was somebody talking about the Calif. NG). Since being discharged from the NAVY in July 2001, i have worked and stayed out of trouble. I have a clean driving and criminal record. Can i join the Guard ?

Other Than Honorable discharge bars you from renelistment.
Both of you will need to feild a BCNR appeal to request an 'upgrade' of your discharge.

Takes about 18 months.

Your best bet is to request only the upgrade of the discharge to General (Under Honorable) on grounds you have changed and include those recommendations.

It will likely be declined.

You can then appeal in district court and get a jury of your peers (civilians).

This is your best bet. If you want to speed it along, file in court now in assumption it will be declined. Otherwise, you are looking at 24 months plus.

Get an attorney.
