I ve been trying to get in for over a year now. I started out wit the active side but was screwed after i was disqualified for a child support warrent. I settled it an my recruiter never sent my waiver up after my six months was up. All of my criminal history was wavied except for the child support. The new fiscal came and all types of things changed. I took my asvb last Jan. an scored a 31, I also have a g.e.d. I cant afford college an already owe finacial aid. I have now been told by a NG Recruiter that he may not be able to get me a waiver because I have 2 felony d.w.i. Then he told me to take the asvb over and try an get a 50. I talked to my old active recruiter and he says that if I get a fifty I will have to go to meps an take it again. I want in bad I have changed my life around sine the d.w.i(2000) can anyone guid me cause Im desperate and dont want to give up even though I have had every obstical the millitary has thrown at me an took it on head strong. HOOAH

Well you definitely have a lot on your plate and your other thread about cleaning your record; well when it comes to misdeamenors, they will stay will you for the rest of your life. You just need to keep clean from here on and dont cause another strike against you. Remember recruiters work with many people and sometimes they need to focus on the ones they can get in right now. So be patient and work with your recruiter. You have time on your side at the moment.

I just found the law.

If you are convicted of DUI with a BAC more than .08%, the penalties are as follows:

First offense
A misdemeanor
Jail time of not less than 10 days and not more than one year
Fine of not more than $1,000

Second Offense Within 10 Years of the First Offense
A felony
Jail time of not less than one year not to exceed five years
Fine of not more than $2,500

Second Felony Offense
A felony
Jail time of not less than one year and not to exceed seven years
Fine of not more than $5,000

Third or subsequent offense
A felony
Jail time of not less than one year and not to exceed 10 years
Fine of not more than $5,000
Once you are convicted of DUI, the Department of Public Safety (DPS) is sent notification of the conviction. They will then suspend or revoke your driver's license, unless the license has already been revoked because the BAC test was refused.

Your license will be revoked as follows:

First revocation: 180 days
Second revocation: One year if there was a prior DUI or drug-related revocation within five years
Three years if there were two or more DUI or drug related revocation in the past five years

So, by the law reads there's nothing he can do.
With 3 DUIs he's not able to enlist.
